Wiwu Terms and Conditions

Welcome to Wiwu! These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Definitions

  4. “AI Feature” refers to any machine-learning or algorithmic functionality (e.g., skin-tone analysis) offered within the Services.

2. Acceptance of Terms

By registering for an account, uploading Content, or otherwise using the Services, you acknowledge that you have read, understood, and agree to these Terms, our Privacy Policy, and any additional guidelines or rules published by Wiwu.

3. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to these Terms.

4. Account Registration

  1. Accuracy: You agree to provide true, accurate, and complete information when creating an account.

  2. License: By submitting Content to Wiwu, you grant Wiwu a worldwide, royalty-free, sublicensable, and transferable license to host, use, reproduce, modify, and display your Content solely to provide and improve the Services.
  3. Responsibility: You are solely responsible for the legality, reliability, and appropriateness of your Content.

7. AI Feature: Skin-Tone Analysis

  1. Accuracy & Limitations: AI-based skin-tone matching is provided “as-is” and may not be perfectly accurate for all users or skin types.
  2. User Consent: By uploading a photo for analysis, you consent to the processing of your image by Wiwu’s algorithms.
  3. Use of Results: Results are provided solely for informational purposes. Wiwu disclaims any liability arising from decisions you make based on AI feature outputs.

8. Fees and Payments

Where applicable (e.g., premium features), you agree to pay all fees and taxes associated with your use of paid Services. All payments are non-refundable except as required by law.

9. Intellectual Property

  1. Wiwu IP: All trademarks, logos, and service marks displayed in connection with the Services are the property of Wiwu or its licensors.
  2. No Implicit Rights: Nothing in these Terms grants you any right, title, or interest in Wiwu’s intellectual property beyond the limited license expressly granted herein.

10. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share your personal information.

11. Disclaimers

  1. “As-Is” Basis: The Services are provided on an “as-is” and “as-available” basis.

You agree to indemnify and hold harmless Wiwu and its affiliates from any claims, losses, liabilities, damages, or costs (including attorneys’ fees) arising from your violation of these Terms or your use of the Services.
